An agreement entered into this 12th day of January 1846 between John Wm Lubbock Bart. of High Elms on the one part and Charles Darwin Esqer on the other part both of the Parish of Down in the County of Kent.

The said Sir John Wm Lubbock Bart. for himself his Heirs or Assigns to let the piece of Land being part of containing A. R. P 1-2-16 adjoining to Land belonging to the said Charles Darwin Esqer in the Parish of Down in the County of Kent for the term of 21 years to commence from Michaelmas day last past at the yearly Rent or Sum of One Pound twelve shillings per Annum clear and free of all deductions. – And the said Charles Darwin Esqer for himself his Heirs or Assigns agrees to hire and take the said piece of Land for the term of 21 years from Michaelmas day last past and to pay the said Rent or Sum of One Pound twelve shillings per Annum and to pay and discharge all Rates, Taxes, and Rent Charge to which the said Land shall be liable. And further agrees to plant, and at the end of the term to leave planted the said piece of Land with Underwood Shrubs and Trees, and to make and maintain a good and sufficient fence against the remaining part of the field by planting and raising a Quick. And the said Sir John Wm Lubbock Bart for himself his Heirs or Assigns further agrees that the said Charles Darwin Esqer shall be at liberty to cut down, prune and cultivate the said plantation in such a manner as he shall desire. And likewise that he shall be allowed to dig Chalk for his own use only. The said Charles Darwin Esqer for himself his Heirs or Assigns agrees to plant sufficient plants of good sorts for making Underwood and to keep and leave the Shrubs and the Shoots. Therefrom protected from injury by Cattle or otherwise; and to leave out not less than 40 of the best Oak, Ash, or Larch per Acre to grow for Timber. In writings whereof the said parties have hereunto set their hands the day and date above written.
